Text of the Fatwa on Yemeni protesters by state clerics
Both the fatwa and the UN HRC council statement will be interpreted by Saleh as a free hand to put down the protests. Saleh followed a similar pattern of obtaining a fatwa prior to launching major assaults on Houthis. NYR | YemenFox | A gathering of hundreds of pro-government clerics issued a controversial fatwa backing the regime and lashing out the opposition on Thursday . The clerics labeled the protests that demand the ouster of the regime as “sinful”, calling them to repent or classified as “aggressors”, whom should be fought against according to Islamic law.
After three days of discussion, the clerics issued communiqué clarifying their opinion on the current situation in Yemen.
“Revolting against the {Muslim} rulers either by words or actions is forbidden under the Holy Quran and Sunnah (the teachings of the Prophet).
According to the fatwa,”The ongoing protests and sit-ins {in Yemen} that are arranged in the public roads and residential areas which cause bloodshed, unsettling security, cutting roads are forbidden according to Sharia”
The Fatwa called upon the clerics who, issued fatwa encouraging people to revolt against the regime, to repent, urging Yemenis to take a lesson from the countries that removed their leaders and how “they still suffer from security and economical turmoil.”
The clerics said that if those who labeled against their leader didn’t repent and didn’t stop fighting security forces and intimidating people, they should be regarded as aggressors.
Yemen clerics urges security services to carry out their duty and protect public and private facilities and bring the perpetrators to justice and the {police} work is regard as Jihad for the sake of God.”
In criticizing the statement, Political analysts considered the statement (fatwa) issued by a group of clerics loyal to Saleh regime on Thursday as a justification for regime’s forces to commit more crimes against civilians in Yemen.
Added, it is a declaration of comprehensive war against Yemeni people.
The fatwa which was issued by the regime’s scholars inhibited the exercise of democracy including the right of peaceful protests and any right against the regime.

In the name of God the Merciful

As mentioned above, the scholars of Yemen, recommend and affirm the following:

نص البيان :
بسم الله الرحمن الرحيم
الحمد لله رب العالمين القائل (فسئلوا أهل الذكر إن كنتم لا تعلمون) والقائل في محكم كتابه (وإذ أخذ الله ميثاق الذين أوتوا الكتاب لتبيننه للناس ولا تكتمونه) والصلاة والسلام على أشرف الخلق محمد وعلى آله وصحبه أجمعين القائل (العلماء ورثة الأنبياء) والقائل (من سئل عن علمٍ فكتمه ألجم بلجامٍ من نار يوم القيامه) وبعد:-
إنه في يوم الثلاثاء 29 شوال 1432 هـ الموافق 27 سبتمبر 2011م عقدت جمعية علماء اليمن مؤتمرا علميا لمدة ثلاثة أيام تحت شعار (نحو رؤية شرعية واضحة ) برئاسة القاضي العلامة محمد بن إسماعيل الحجي رئيس الجمعية شارك فيه جمع من أهل العلم ن مختلف محافظات الجمهورية على اختلاف مذاهبهم ومشاربهم لمناقشة الأوضاع الراهنة على الساحة اليمنية .
وقد قدم العلماء فيه عددا من البحوث العلمية التي تناولت أهم المواضيع التي تدور في الساحة اليمنية منها :
- تحقيق الاجماع على عدم جواز الخروج على الحكام
- طاعة ولى الأمر وحكم الخروج عليه
- نصيحة العلماء للراعي والرعية
- صور الخروج على ولي الأمر وأحكامها
- بم تثبت الولاية
- واجبات الحاكم نحو الرعية وواجبات الرعية نحو الحاكم
- الفتنة وسبل النجاة منها
- النصيحة لولي الأمر وكيفيتها
والتي أثريت بالنقاش المستفيض وقد أنبثق عن المؤتمر البيان التالي :-
أولا: إن الخروج على الحكام محرم شرعا سواء كان بالقول أو بالفعل بنص القرآن والسنة المطهرة والإجماع قال تعالى ( يا أيها اللذين آمنوا أطيعوا الله وأطيعوا الرسول وأولى الأمر منكم ) وقال صلى الله عليه وآله وسلم ( ألا من ولي عليه وال فرأى منه شيئأ من معصية الله فليكره ما يأتي من معصية الله ولا ينزعن يدا من طاعة ) رواه مسلم .
وقال عليه أفضل الصلاة والسلام (من رأى من أميره شيئأ يكرهه فليصبر فإنه من فارق الجماعة قيد شبر فمات فميتته جاهلية ) رواه مسلم ، وقد نقل الإجماع أكثر من عشرة من الأئمة منهم الإمام المزني والإمام البخاري والإمام القرطبي وغيرهم وما نقل من خلاف من البعض فهو إما قبل انعقاد الإجماع فالإجماع يرفعه أوبعد انعقاد الإجماع فالإجماع حجة عليه .
ثانيا :- يؤكد العلماء على تعظيم الحرمات الآتية:-
1 حرمة سفك الدماء وإزهاق الأرواح والتسبب في ذلك
قال تعالى (ومن يقتل مؤمنا متعمدا فجزاءه جهنم خالدا فيها وغضب الله عليه ولعنه وأعد له عذابا عظيما ) ولقوله صلى الله علية وسلم ( إن دمائكم وأموالكم وأعراضكم حرام عليكم كحرمة يومكم هذا في شهركم هذا في بلدكم هذا الا هل بلغت اللهم فاشهد )
2 حرمة الاعتداء على المعسكرات والجنود الذين يقومون بواجب حفظ الأمن والنظام في البلاد .
3 حرمة التعدي على المنشئات الخدمية والممتلكات العامة والخاصة .
4 حرمة التعدي على المساجد وتدنيس قدسيتها بالتمترس فيها وإثارة الفتن فيها
5 حرمة الاعتداء على حق التعليم وإغلاق المدارس والجامعات أمام طلاب العلم .لقوله صلى الله عليه وآله وسلم (طلب العلم فريضة على كل مسلم )
6 حرمة ترويع وتخويف الآمنين بإطلاق الأعيرة النارية في الأحياء والمناطق السكنية .
7 المظاهرات والاعتصامات الحالية في الطرقات العامة والأحياء السكنية وما يحدث فيها محرمة شرعا وقانونا لما يترتب عليها من مفاسد كسفك الدماء والتعدي على الأمن وقطع للطرقات وإقلاق للسكينة العامة ولما تحمل من شعارات مخالفة للشرع .
8 حرمة الاستجابة للدعوات والمخططات المغرضة الداخلية والخارجية الداعية لتفريق الأمة وتمزيق الوطن .
9 حرمة تضليل الشباب وتعبئتهم والزج بهم في أعمال العنف وما يحصل اليوم لا يعد جهادا بأي وجه من الوجوه .
10 حرمة الاعتداء على الأعراض والاستهانة بها من خلال السب والقذف والتشكيك في النوايا والمقاصد والتهديدات والتصوير المسيئ .
ولما سلف ذكره فإن علماء اليمن يوصون ويؤكدون على الأتي :
1 دعوة علماء اليمن جميع الأطراف إلى تحكيم كتاب الله وسنة رسوله الأعظم صلى الله علية وآله وسلم وما أجمع عليه علماء الأمة .
2- يدعو علماء اليمن جميع الأطراف إلى رفع المظاهر المسلحة حقنا للدماء وتحقيقا للأمن والاستقرار .
3 يدعو علماء اليمن ولي الأمر إلى العمل على إزالة المظالم والتوجيه بسرعة البت فيها .
4 – يوصي علماء اليمن بالاهتمام بالنازحين في محافظتي صعدة وأبين والعمل على رفع معاناتهم والعناية بهم .
5 – يؤكد علماء اليمن على أهمية قيام الجهات الأمنية بمسئولياتهم وخاصة في حماية المقرات والمنشآت الحكومية والمدنية والأسواق التجارية وتقديم الصائل للقضاء ويعد عملهم على استتباب الأمن جهادا في سبيل الله .
6- يدعو علماء اليمن جميع الأطراف إلى الاحتكام للعقل والجنوح للسلم والجلوس على طاولة الحوار للخروج بحلول مرضية.
7- دعوة من أفتى بجواز الخروج على ولي الأمر إلى تقوى الله ومراجعة أنفسهم ومراقبة الله في السر والعلن والالتقاء بالعلماء والتحاور معهم على محكم كتاب الله وسنة رسوله الأعظم صلى الله عليه وسلم.
8 – يحث العلماء جميع أبناء الشعب الالتزام بالبيعة المنعقدة في ذمتهم والوفاء بها عملا بقول الله تعالى ( وأوفوا بالعهد إن العهد كان مسئولا).
9- يدعو علماء اليمن الخارجين عن الجماعة من عسكريين ومدنيين بالرجوع إلى وحدة الصف ولم الشمل والوفاء بالعهد والقسم .
10- يقدر علماء اليمن الجهود الطيبة المشكورة التي بذلتها دول الخليج وعلى رأسها المملكة العربية السعودية لمبادرتهم في حل الخلاف ورأب الصدع ويناشدونهم بمواصلة الجهود.
11- يحث علماء اليمن الجميع بأخذ العبرة من الدول التي اتبعت نهج الثورات والانقلاب المسلح وما تعانيه من اضطرابات أمنية واقتصادية.
12- يدعو علماء اليمن الدولة للعمل على حل قضايا إخواننا المواطنين في المحافظات الجنوبية.
13- يحث علماء اليمن الحكومة على المسارعة في تخفيف معانات الشعب وتوفير المشتقات النفطية والخدمية والحد من التلاعب في الأسعار ومحاسبة المتلاعبين بها.
14- يدعو علماء اليمن سرعة إخلاء الجامعات والمدارس ليتسنى للطلاب مواصلة التعليم وكذلك سرعة إخلاء العمائر السكنية وعدم التمترس بها.
15- يدعو علماء اليمن الإعلام المرئي والمسموع والمقروء إلى التزام الحياد وتجنب المهاترات والبعد عن إثارة النعرات الحزبية والمناطقية.
16 – يدعو علماء اليمن قنوات التلفزيون والإذاعة الى تسليط الضوء على بيان علماء اليمن وتوصياته بتخصيص حلقات نقاش حول هذا المؤتمر .
17 – يوصي علماء اليمن وزارة التربية والتعليم والتعليم العالي بكل أنواعه بالقيام بواجبهم الوظيفي وعدم الزج بالشباب والأطفال في المهاترات الحزبية والسياسية وإضافة مادة علمية للمنهج الدراسي تحث على حب الله ورسوله وحب الوطن وحقوق ولي الأمر وفقا للشريعة الإسلامية .
18- يطالب العلماء بسرعة كشف حقيقة الاعتداء على جامع دار الرئاسة وسرعة تقديم الجناة للعدالة.
19 – يدعو علماء اليمن إلى تشكيل لجنة من العلماء من جميع الأطراف للحوار والتفاهم والخروج بحل مرضي للجميع.
20- من خلال إطلاع علماء اليمن على كلام أئمة أهل العلم من السلف والخلف تبين لهم أن الخروج بالسلاح على ولي الأمر يعد من أعلى درجات الخروج ويدعون من خرج بالسلاح إلى الحوار والكف عن الإستمرار في قتال القوات المسلحة والأمن وإخافة الآمنين عملا بقوله تعالى(إنما المؤمنون إخوة) فإن كفوا وإلا فحكمهم حكم البغاة
ويدعوا العلماء القضاء إلى سرعة البت في حادث يوم الجمعة الـ18من مارس
21- يدعو علماء اليمن الخارجين عن الشرعية في صعدة إلى ترك التمترس في المدارس والمنشئات العامة والخاصة ورفع المظاهر المسلحة من المدن والطرقات .
22-يؤكد علماء اليمن على أحقية الشعب الفلسطيني في إقامة دولة كاملة ومستقلة وعاصمتها القدس الشريف ويناشدون دول العالم وفي مقدمتها الدول العربية والإسلامية سرعة الإعتراف بدولة فلسطين.
وختاماً فإن علماء اليمن يُذكرون جميع الأطراف بكتاب الله وسنة رسوله الأعظم صلى الله عليه وآله وسلم والالتزام بهما مذكرين أنه مانزلت من عقوبة إلا بذنب ولا ترفع إلا بتوبة مصداقاً لقوله تعالى(ظهر الفساد في البر والبحر بما كسبت أيدي الناس ليذيقهم بعض الذي عملوا لعلهم يرجعون)..وقال رسول الله صلى الله عليه وسلم (وجعل الذل والصغار على من خالف أمري)
وفق الله الجميع لما يحبه ويرضاه وجنب اليمن كل مكروه ووقاه إنه سميع مجيب.
